Pre-employment background checks have become a standard part of the hiring procedure for most employers. Since each employee represents a large investment of time and money, employers want to make sure they get it right. Just one bad hire can become a legal and financial nightmare. At the same time, background checks are subject to a great deal of litigation, regulation, and legislation, especially in California where the rules are different than the rest of the country. Employers need to both exercise due diligence in employee selection and ensure they navigate through a maze of California and federal rules. Under California rules for example, failure to comply with numerous technical requirements can lead to demand for $10,000 in civil damages for each and every violation. The use of criminal records has also become a hot-button issue. This interactive presentation will equip employers to recognize critical compliance issues, including the new prohibition on salary inquiries, ban the box laws, and a number of "only in California," laws that are critical to understand.

About the Speaker - Lester S. Rosen

Lester S. Rosen is an attorney at law and CEO of Employment Screening Resources, an accredited national background screening company located in Santa Clara.

He is also a consultant, writer, and frequent presenter nationwide on pre-employment screening.

He has qualified and testified in the California, Florida, and Arkansas Superior Courts as an expert witness on issues surrounding safe hiring and due diligence. He has been quoted extensively in numerous Human Resources and national publications.

Mr. Rosen was the chairperson of the steering committee that founded the National Association of Professional Background Screeners (NAPBS), the official voice of the background screening industry, and served as the first co-chairman in 2004.
